My question involves child abuse or neglect in the State of: New York
I have a child under 8 months old and he resides with his mother. We were never married but were dating for 2 years. I was over her apartment and we had a verbal argument and I left telling her I was going to take her to court for custody. She got mad and the next day made a police report telling them I was being violent and was a danger to my child. I never once laid a finger on my child or his mother.
From what I understand she told them I smacked her arm, and told them I was walking around with a knife. Never said anything about threatening anyone with it or holding it to anyone. But, just the statement of "holding a knife".
Now I understand she acted out of emotion. She wants to take back what she said and withdraw her petition for custody. I would too honestly would rather work it out outside of court.
But, to make matters worse, she said CPS is involved and that I cant see my son or they will take my son away from her. She was told this by some adviser lady that worked at the police station and not by CPS themselves. CPS never investigated the situation within 24 hours, never even seen my son yet in person. In fact they made an appointment a week after the report was made and never showed up and then re-scheduled to see my son a week later. So thats almost 2 weeks without making an investigation and seeing my son in person or where he lives.
No police has called me, and when I called the station they told me it came up as a "complaint" and I had to talk to the specific officer that wasn't there at the time. And CPS has not called me either, at all. I know people that work for CPS in my area and they told me all the rules they have to follow. However, I want to know what I should do to clear my name, get CPS off my back and be able to see my son.
