    Default Adverse Possession in Texas

    My question involves real estate located in the State of: Texas. I live next to several lots of vacant land that I've been keeping clean and mowing for over 35 to 40 years. I did not keep receipts. I only have neighbors to witness my claim. Now the land is up for sale. Also there are a few other buyers inquiring about the property. Can I claim adverse possession and can I put a lien on the property to stop the selling process?

    no

    You may have a claim of adverse possession. So, if you want to try to claim the land, you must file suit to quiet title. You can file a lis pendens which would effectively prevent the sale of the property when you file the quiet title action.

    Your neighbor's witness testimony is valuable. You might win.

    Hopefully the owner of the property isn't depending on the sale of the property for their livelihood. I'd feel pretty bad delaying sale of a property if someone needed the cash for a loved ones life support.

    On the other hand, you've kept it clean, so they should offer you something for your efforts.
