    Question Charged with Larceny but Left the Store Empty Handed

    My question involves criminal law for the state of: Oklahoma

    I was charged with larceny of merchandise from a retailer of wholesale

    I was thinking of taking some food and I put some food items in my purse but before leaving the store I decided it was not a good idea to take anything so I put the food back not where I found it but tossed it in another area of the store and I left the store with NO stolen goods on my person

    2 steps out of the store and the manager told me to come back into the store to ask me some questions, he said someone saw me put food into my purse and wanted me to give it back, I told him I took the food out of my purse and tossed it in the store, he wanted to know where I put it, I told him I would show him, but he wouldnt let me do that, well first he asked me if I ever took anything I told him no, then after not letting me show him where I tossed it, another employee brought the food items into the office and the manager wanted to know why I lied to him about putting food into my purse, I started to cry, he told me that he was pressing charges and has called the police, he said if I was truthful in the begining he would have just told me to leave the store and never return.

    So the police officer came and I was in tears and the officer was asking me questions about my marital status and where I lived and why I would take food without paying for it. I explained why but at the same time told him I didnt feel right about what I did and put the food back before I left the store.

    The officer also insisted that I give him my husbands phone number so he could call him to let him know I was being taken the police station, I cried and cried and begged him not to call my husband, the officer told me I had no say so in that, I asked him why he needed to tell him and he said just in case of an emergency.

    I was handcuffed and put into the police car and taken to the police station and booked, they took my photo from every angle possible and then asked a bunch of medical questions, I posted bond 174.00 bucks!

    I was given a court summons with a court date

    I dont see how I was charged with larceny since I exited the store empty handed. I was also NEVER read my miranda rights.

    I know I was doing wrong but made it right by NOT leaving the store with unpaid food.

    Do I have any chance of getting the charges dropped?

    I also told the cop that this was unfair, especially since last week some old man charged with sexually assaulting a child got a 20yr suspended sentence and didnt have to pay one dime, but I on the other hand felt like I was being treated as if I committed murder!! The cop said, well thats just the way our town works.

    How in the world could I be arrested and charged for something I didn't do? And why was my rights never given to me?

    Oh BTW- I did ask the cop why I was being charged, he told me it was based on intent, if this is the case, then why wasn't I charged with intent to steal instead of larceny?

    Any advice would be greatly appreciated
