My question involves labor and employment law for the state of: Louisiana

I work for a collection agency and I am paid a small salary and a commission on the fee the collection agency receives when an account is collected. 75% of my compensation comes from the commissions I earn.

I receive accounts to be collected in two ways. The first way is through an auto assign process that distributes the business (bad debt) to all the collectors based on certain criteria, (i.e...balance size, age of the debt...etc). The other way I can receive business is through a "Hot Hit"

Basicly, the sales reps and or management that work for the collection agency can either decide to put an account into the auto assign process where the business (dab debt) is distributed evenly to all collectors or they can choose to Hot Hit the account to a specific collector(s).

As a result of this Hot Hit policy the majority of the collectible accounts are moved to certain collectors who have ties to management or top producing sales reps. The majority of the accounts that are distributed through the auto assign process are accounts (bad debt) with very low collect-ability factors.

For example: a debt that is 2 years old and where the company is out of business would be distributed through the auto assign process. Conversely a debt that is less than 90 days old, and where the company is in business and has substantial assets to resolve the debt would be assigned via the Hot Hit policy.

My question is:What rights do I have under labor laws or any other law that would help me challenge this Hot Hit policy and help make the distribution of business to all collectors fair and equitable?

My job performance is directly associated with my ability to hit my fee quota by collecting the business (bad debt) that is assigned to me. The majority of the accounts that I receive are from the auto assign process while several of my colleagues who I am in competition with for promotion, demotion or termination receive the majority of their business from Hot Hits.

I Hope you are able to understand the scenario surrounding my question correctly. If you have any questions please let me know. I look forward to your feedback!
