    Default How to Help My Wife Gain Legal Status

    I am a US citizen that resides in california. I am married to an ilegal mexican immigrant that came to the US when she was only 4 yrs old. Now she is 22 and we have been married for over 3 years now. We have 2 kids and she a full time college student (on & off ) for the last 4 yrs.

    Three years ago we contacted a local immigration law office which (wasnt very helpful) for assistance. They said she would have to leave the country in order for us to file for her to obtain a green card.
    I would like to know if there are any other options we might have? and if they can take into consideration the fact that she is trying to better herself by attending schoool & she wasnt aware of her migration here at the age of 4?

    any help would be appreciated.

    USCIS considers that she's known about her status since she was at least 18...

    Unfortunately what you were told is correct. She will have to leave the country first. She's then subject to an automatic 10 year bar, but she CAN apply for a waiver.

    I really suggest you have at least an initial consultation with an attorney
