    Question Jurisdiction for Divorce

    i was born and raised in MS. for the past 3 yrs, ive lived in FL-the only time i ever lived outside MS.

    i know this makes me a FL resident, but i have nothing to prove this-i dont work, drive, vote-basically i dont exist.

    i plan to leave my husband, but i cant afford to live alone, yet. i will be going immediatly to my parents in MS. i need to start college by Jan 07, lest i have to wait till jan 08-its a yr long training program.

    it will be difficult to drive back and forth btwn FL and MS everytime i have to do something legally- divorce, custody, getting driver's license, as well as i need my name changed before i get my license. and i cant wait 6 months to become a MS resident. i need to drive, and go thru the processes of getting into that college program. and everything else.

    are there any special circumstances where a state will take jurisdiction without waiting till youre an official resident, especially if you were born in that state? i personally would consider the above as such a circumstance.

    so, who will likely have jurisdiction with all this stuff i have to do?

    well, ive just read some stuff.

    i think it would be better to file for divorce in FL. MS doesnt seem to consider dom. abuse as a factor in deciding custody, and it looks like their pretty hard-core with joint custody.

    ill just have to make the drive over here, or do you think the local women's shelter would take me in temporarily, at least to get a FL driver's license?
    i dont have any friends or family here, so i have no where to stay otherwise. what a joke this whole situation is!!!!

    yeah, that's the way, mr. man, just lock the wife up, so she no longer exists, and noone knows she exists. thatll ensure she wont leave you, cuz no one's gonna help someone who doesnt exist. after all, the only reason why im not legally dead is cuz there's no official death certificate. well, he can throw a big baby tantrum for all i care. ill drive 6 hrs both ways several times a week if i have to!!!!!

    How old is the child? Is the child enrolled in school or daycare? Have either you or the child received medical care in Florida?

    yes, i gave birth to my 3rd child here, and all my kids have seen doctors here, as well as preschool for my 2 older kids.

    If the children have been in Florida for six months or longer, that is the proper place to bring a custody action. You should be able to establish your (and their) residency throug medical and preschool records.
