    Default Expungement of a Public Intoxication Charge

    My question involves expungements or pardons for the state of: Indiana

    4 years ago I got arrested driving home from a night of skiing. 4 guys in the car. Driver was 100% sober and got pulled over for speeding. I was passed out and didn't get out of the car when the cop instructed me to. That night I got charged with PI, resisting, and disorderly. The other 2 guys in the car were cited for underage consumption. The resisting and disorderly charges were later dropped, and I got charged with the PI.

    When (if ever) can I begin to file for expungement? It is getting rather old having to explain myself every time I fill out applications. I fulfilled all my probation requirements, I work full time as a teacher and am very involved in the community. I really hate having this red flag on my resume and would like to know if I could ever get it to disappear.

    From what I can see, in Indiana you are only eligible for expungement if you were arrested but no charges were filed, or charges were filed but dropped due to mistaken identity, a determination that no actual offense was committed, or absence of probable cause. You may also qualify if you obtain a pardon.

    Once more than fifteen years have passed since your discharge from probation, incarceration, or parole, you can petition the state police to limit access to your criminal history. If this succeeds, access is limited to criminal justice agencies.
