    Question Pulled over by State Trooper, Then Possibly Harrassed

    Heres the honest story.


    Work is done, Driver in Box-truck leads me to the turn-around exit.

    Hiway (Route 1) is divided north and south.

    After we turn around, i tailgate him. Chevy truck, Box-truck, Then last me, Drive through a Yield sign southbound to boston.

    SO... i pull out in front of a state trooper , 50 yards behind me..

    He immidatly stomps on the gas pedal and throws the blues on.

    i immidatly pull over, seat belt already on (I'm in a 1997 plymouth voyager, clean mom type car, very inconspicuous)

    Conversation goes like this.. (while im on the phone with the wife, so she can hear)

    trooper: license registration
    here you go sir.
    trooper: do you know why i pulled you over
    no sir
    trooper: did you see the stop sign??!
    no sir
    trooper: what type of drugs are you on
    albuertol, for asthma sir
    trooper: yeah thats not going to effect your eyesite
    trooper: what other drugs are you on
    none sir, i dont understand the queston
    trooper: your eyes tell me you are on methadone
    trooper: "you look ****ed up mr smith"
    trooper then walks to the car and calls a local cop for backup
    trooper comes towards my car after 2nd car arrives and opens my door
    trooper: step out of the vehical mr smith
    hes standing over me, telling me to get out.. i go to unlock my seatbelt and he goes for a weapon gun or mace,, heh great.. so im like you have you move sir so i can exit the car.
    trooper stands back.

    trooper: walk to the back of the car
    trooper pushes me from behind
    you dont have to push me sir
    trooper pushes me aggresivly
    what the **** asshole dont ****in touch me pig
    trooper then conducts a eye test with a pen.. moving it around and i have to follow it with my eyes, no head movement

    im laughing at this point,
    this is bullshit, **** you you cant do this shit this is illegal blah blah

    cop searches my car, rips down the glovebox, throws some cloths around blah..

    he now comes back and harrasses me more about my previous record.. which is totally irrelivant in my opinion,, he also searched my closed backpack inside the vehical.

    guys like get back in your car, im like yeah whatever asshole...

    writes me a ticket for X dollars, Stop sign violation...!!!! (i went back and took a picture of the yield sign)..

    so whats the deal? is this BS Harrasment? he comes to my car and gives me a stop sign ticket ,
    trooper: do you have any questions
    whats your name and badge number sir
    * trooper walks away
    ASSHOLE i yell heh..

    yeah he also made me hang up the phone with my wife when he took me out of the car.. next time im gunna keep my video camera on record..........what do i do during the appeal with the magistrate in court? its a civil ticket. he did mark 'vehical searched' etc..

    Just take pics of the subject sign and relevant street name signs. Show them to the DA and he should just cancel the ticket. If not, make a court date and question the COP about the sign ONLY. Forget about the harassment and crap. The judge has heard it all before and simply won't care. If you want to file an official complaint AFTER the trial, feel free. But you were plenty "lippy" to the cop and I doubt you would be taken very seriously. I'd just forget about it.

    You have to know that not all cops behave in a professional manner 100% of the time. All you can do is be the calm, rational one, so that when it goes to court, you look like "the good guy".

    Before you argue "stop" sign versus "yield" sign, be sure to check the laws. Your citation should contain a reference to the statute or ordinance by number. Look it up. I mention this because in WA, for example, RCW 46.61.190 governs BOTH stop and yield signs. Unless the officer included the specific paragraph, the prosecutor would argue that the "stop sign" on the ticket was a clerical error and non-prejudicial. The officer would then state that you went through the yield sign directly in front of him, effectively cutting him off and creating an "immediate hazzard."

    HEY its me, i won the case it was thrown out immediately. i haven't pursued the harassment of the officer and the illegal search.. but theres a new shiny stop sign there now.
