My question involves independent contractors in the state of: Virginia
I had a baby and added my newborn to my insurance by notifying my employer of the birth and completed all the paperwork for the insurance company to add my child. I was told everything was processed and I was good to go. I had my child in June 2009.
In January 2010 I get an email from my then employer notifying me that they assumed their payroll processor was making the proper deductions based on their instructions and now they want me to pay the difference between employee and family coverage. I kindly informed my employer that because it was their mistake and that I did everything I was required to do, it was not my issue but theirs. At that point, my then employer let the issue drop.
Fast forward to now, I accepted a new job at the beginning of this month, June, and now my former employer is going to take my remaining vacation to pay the debt from their mistake and is requesting that I send them a check to make up the difference. I was under the impression that the issue was dropped as no action was taken by my former employer since their note to me in January 2010. There was no deduction for the back benefits taken from my paychecks since their note to me in Jan.
Am I now responsible for their mistake even though they, my former employer, decided to take no action until I accepted my new position?
