    Default California Traffic Court - Steps to Get a Speedy Trial with TBD

    My question involves a speeding ticket from the State of: California VC 22349(a) exceeding posted speed of 65mph.

    I received my ticket on June 6, 2010.
    My appearance date from the Notice to Appear is June 29, 2010.
    My due date from the Courtesy Notice is July 12, 2010.

    What steps do I need to take to ensure a "speedy trial" if I want to use a TBD?

    In other words, are the steps as follows:
    (1) submit my not-guilty plea at the courthouse with the clerk at the same time I request my TBD (i.e. not via mail which various threads have indicated waives your right)
    (2) get a trial date from the clerk
    (3) submit by TBDbefore the trial date set above

    Also, if the clerk sets a trial date that is more than 45 days from when I enter my plea, what do I say/do?

    Please let me know if I am missing anything.

    Speedy trial provisions do not apply to the TBD process... It may take months from the date you request a TBD to the date you get the final decision.

    You can read California Rule of Court #4.210 to get a better understanding of the TBD process.
