    Default Enforcing a Visitation/Parenting Plan Not Signed By the Judge

    My question involves a child custody case from the State of: Nebraska


    For some reason, the parenting/visitation agreement that my ex-wife's attorney drew up was signed by my ex-wife and I but NOT the judge when we got divorced. She has stopped letting me see my son recently and all I want is to have the original visitation agreement to be "legal and binding" to where she could be held in contempt if she continues to deny me my son. She knows that the visitation agreement isn't signed by a judge so she feels like she can do what she wants with no consequences. How do I go about getting a judge to sign the agreement? Also, would the judge sign it now seeing that it's been 2 years since my ex and I signed it? Unfortunately she and I do not get along at all so if/when she finds out that I'm trying to get a judge's signature on the agreement I'm sure she will contact her attorney and disagree with anything she can in regards to the original parenting plan. ANY help would be GREATLY appreciated.

    If you for some reason didn't have a visitation or custody order entered by the court, and chose not to follow up when you recognized the omission, clearly it will be more difficult for you to enforce your parenting time. I do suggest bringing a motion to have the custody and parenting time issues reduced to an order. Given the passage of time I can't promise that the judge will do that without requiring additional proofs, particularly if your ex- won't stipulate to the entry of the order. If you expect her to team up with a lawyer to fight your effort, it would make sense for you to retain a lawyer yourself.
