My attorney has advised me to file for sole legal and physical custody with a supervised visitation parenting plan for my STB ex.
My STB ex is a DUI felon and did 6 months on work release for the last six months of our daughter's first year.
He has also been arrested for DUI one other time but that was demoted to driving with an open container. (So, five arrests involving driving and alcohol.)
All DUI and alcohol related arrests occurred before I got pregnant. I only knew about the last one because we were married. I found out about the other three after I was 3 months pregnant.
To compound matters, I have evidence that he is drinking again. I also have witnesses who saw evidence he is drinking again - beer hidden in styrofoam soft drink cup - cooler with ice containing eight beers - stashed empty beer cans hidden in garage and 2 large 55 gallon bas containing empty beer cans.
The man is a drunk. What are my chances to get sole custody? The parenting plan drafted is quite liberal - every other weekend the whole weekend and extended periods during the holidays. He just has to have his sister or mother present. There is also a clause where he is to abstain from alcohol for 48 hours prior to visits and while the child is with him and that he will be subjected to random alcohol testing. (Don't know if a judge will buy that, but it will be on my dime.)
