    Default Reinstating Unemployment Benefits Because New Job Sucks

    My question involves unemployment benefits for the state of: CA

    I was on unemployment for 6 months. I started a new job with the SAME company that was paying my benefits. The new job is not working out. I may have to quit or may be fired in the coming weeks. Can I restart my benefits or am I SOL?

    If you quit, no.

    If you're terminated for cause, no.

    If you're laid off through no fault of your own, yes.

    They may terminate me with the reason of "performance issues", can I argue that their expectations were set so high that I can not meet? Which is true.

    The manager created an uncomfortable work environment for me which cause me to fail.

    Are those reasonable arguments?

    Performance issues *generally* do not disqualify you for unemployment benefits. The burden of proof would be on the employer to show that you could have worked to standard and deliberately chose not to.
