My question involves bankruptcy in the state of: Arizona
I have not filed BK yet, and not sure which route an attorney will recommend, ch. 7 or 13. I have a question about income. As I read it, the past six months' of income are used as a gauge to decide if one can file 7 or 13.
The problem is that my income is going to drop around the end of the year. I am no longer working due to failing eyesight. I will be going on company disability, which I am not happy about, but I finally faced the fact that my doctor and employer were right, it was time. I am currently receiving full pay until the end of the year.
If a bankruptcy judge takes my past income into account, it will appear as though I could and should be making payments. I'm trying to gear up for the fact that very soon my gross income will drop by one-third. I need to get my expenses down to match my income or I cannot survive financially.
I have a lot of credit card card debt, I'm sorry to say. I stopped making payments on several over six months ago. My home is underwater. I have a car payment but that's paid off in spring of next year, so I'll reconfirm that and hopefully get to keep my car.
Does anyone know if a future event -- guaranteed and confirmable by my employer, not a What-If scenario -- will be taken into account by a bankruptcy judge in making a determination? I can't wait to file until six months after my income has dropped, as I've already received notification that I'm going to be sued for debt collection in 30 days.![]()
