    Default Young Teen Facing Assault and Battery Charges

    We live in MI. We just got a letter in the mail today, from the court. It states someone is accusing my 13 yr old daughter of assault & battery. My daughter has never been in a fight. I am so scared. I don't know what can happen to her. I am just thinking the worst. I don't know who or what we are against. We meet with the referee in 2 weeks. This waiting is killing me. What are our options and what is the usual process? My daughter has never been in trouble, gets straight A's and is never a problem. What is the general outcome for this kind of thing? I am very scared. My daughter has never hurt anyone, but why was it so easy for someone to press charges against her? Its this other person's word against my daughters.

    Did your daughter give you any indications that she's had trouble or issues with anyone?

    She has never been involved in any fights. During school she got the occasional teasing from other girls, but nothing that ever turned into any violence or harm. The only thing that I can think of is kind of old, so I am unsure if it would be this incident. There is a foreign girl who moved to her school. She didn't speak any English and has very, very strict, formal family/race/religion beliefs. She thought my daughter and other girls were teasing her and also not being her friend, because she couldn't understand American mannerisms and was not good at English yet. Throughout the school year, there were 3 incidents with this girl, accusing my daughter of something. My daughter even called her, hoping they could be friends. Then, at the end of April, beginning of May, I was asked to come to the school to meet with this girl, her dad and my daughter. It also included one other girl and her mom. The accusing girl did also have an American relative with, who could help translate better. The girl accused my daughter of hitting her in the back, 2 months earlier, but was just now accusing her. My daughter did not hurt her, she never touched her. The girl claimed that someone came up behind her and ran into her, very hard, hurting her back. My daughter and several girls were at a locker behind her. My daughter doesn't even know who ran into this girl. The girls never saw anyone hit her. So, basically at this meeting in April/May, we all agreed that we couldn't really come to an agreement or conclusion. The girls agreed to keep to themselves, stay away from eachother. This would eliminate any more false accusations and hopefully the foreign girl would feel better about this. This girl accused my daughter of something about every 2-3 months at school. Everything would be going fine, then my daughter would tell me she was accused of teasing this girl, hurting her feelings, being mean or something. This girls father did state that she went to the DR after her back got hurt and the DR said it was bruised. This girl never saw who hit her back and there were no witnesses. I thought everything had been resolved with this.

    Sounds to me that you are being sued by the foreign girls parents for there daughters medical bills relating to when she was pushed in school.

    If your daughter was being charged with a crime then a letter wouldn't come to the house, a knock on the door would or a phone call to you asking to come down to the police departments juvenile bureau.

    It could be a summons. It could be a petition for a restraining order.

    If it were a lawsuit, it wouldn't result in a meeting with a juvenile court referee.
