My question involves criminal law for the state of: Pa and NY
Three years ago I get arrested for the 1st time in my life. Living in and resident of Pa. Arrest was for ARD DUI....1st time offense. At the same time I get a divorce, completely freak out, have a nervous breakdown and never pay the fine or follow through with anything. So my DL is suspended in Pa. Took a job in NY and get arrested for DUI...1st time offense in NY. They never knew at the time that I had been arrested in Pa??? So......I never go to the arraignment in NY. yes...I know I was a moron so no flames please. In any event I end up in rehab....life is better now etc....blah blah.
I am living back in Pa. One year ago the Trooper from NY calls me and wants me to come back for court for the NY arrest. I write a letter to the NY Judge explaining everything, copy the NY DA and the Trooper. I give them my Pa work address and home address and told them I have no license and all my family is on the west coast and no way to get there (the complete truth).......this is upstate NY....bus would be about 15 hour ride from where I live in Pa.. I told them if they want to extradite me they can come for me as I am not running, just no way there. I get nothing in the mail, no more calls, etc... They threatened a bench warrant but I never heard from them.
I finally get the nerve up to call the DUI Center here locally in Pa and explain how my life spiraled out of control etc.... The Pa Probation Officer says she will reinstate my Pa. DL. I just need to do the Highway Safety Class. I am scheduled 7/1/10.
The question is.....will my Pa DL be reinstated as the Probation Officer states....does Pa even know about the NY arrest. I mean everyone has my address and phone number so if there were a warrant out for me I assume I would have been advised?? My plan is to deal with the NY issue once I get my Pa DL back.....assuming as the Probation Officer says I will. She put me on hold for quite a bit of time so I assume she did an updated criminal check on me. Please clue me in on the reality of my situation. Thank you
