    Default Aggressive Contacts By a Lender Over a Delinquent Loan

    This is a long story but I will try to keep it short without omitting important details.

    BACKGROUND: I bought a car in Aug of 2008 with a loan from the bank that held the rest of my financial assets. In 2009 our auto insurance company over drafted our account by withdrawing money early and multiple times. This happened while we were on vacation and did not know for 12 days. When we came back we asked both the bank and insurance company what had happened, the insurance company made multiple conference calls with us to the bank trying to work things out, but the bank was VERY unreasonable. End of the story is we got 60 days behind. In Aug 2009 we had a little extra money and spoke to a supervisor at the bank. The arrangement was for us to pay the two payments we were behind and the current payment would simply push to the end of the loan. We followed through with this agreement and started normal payments again in SEPT 2009 and have not missed one since.

    CURRENT ISSUE: Recently the bank as gotten EXTREMELY aggressive with us and threatening repossession. They are saying the the gentlemen (a supervisor) who made the agreement was not authorized to make such an agreement and beyond have lost record of any such agreement. We never signed any additional paperwork, this was my mistake . Over the last few months the escalation of aggressiveness has really taken off and where my question is. At first it was a few calls a week, then everyday, then multiple calls each day, then calls and letters, then calls with UPS overnight letters, then calls to me letters and calls to mother, sister, brother and mother-in-law stating they were trying to reach me about the car. Today they sent UPS overnight letters to my home/place of employment (I am the quasi owner of a business NOT in my name the legal issues here are unrelated and do not care to discuss them) and my mother. They were addresses as follows:

    Mother's name
    My name
    Mothers address

    It was the same for the place of employment. I am very troubled that they have done this and it seems that it can/should not be legal to do such a thing. What can I do about this? I do have a current (in my mind at least) loan with them and need to receive important information from the bank but prefer not to be harassed by them and do not want them contacting my family.

    How about catching up with the loan in their mind. You apparently have no written confirmation of the deal you made, and neither do they, and they don't seem at all inclined to bend on the issue.

    You are correct, the bank does not seem to be willing to bend, and the farther that it goes, the less willing I am to bend making the situation worse. Before all of this, we were in the early negotiation process of buying a new home, we will be keeping our exsisting property but living in the new one. I may just move there, a rural area 4 hours away and nof bother telling them anything about it. I work in a building with a secured parking area that is not visable or available to the public and I have always parked my car in the garage. I know that this is not nessasarily the best option, I am just very, very upset with the handling of our loan. I only missed one payment and immeadiatly made aragnments with them. At no point did I try to walk away from the payment or anything.
