My question involves child support in the State of: NH
I am a confused young male and do not know what to do in my case. My ex has no legal custody at all of my 5 year old daughter, my daughter has lived with her grandmother(ex's mother) in Massachusetts for almost 4 years and has had legal permanent guardianship since 6/28/07 and has lived with her before that since 12/10/06. My ex filed for child support in April of '09 through DCSS. I got a letter about this 9 months later saying this. "CP completed application in April 2009 requesting child support. Obligation has ended because DCSS did not have address for her. Now that we do, obligation will continue at $86.00/wk. Had to reopen based on application, therefore you owe an arrearage of $3,010.00" This was the first time I ever was notified about this. I had already paid $688 to DCSS because I owed the state back because ex was on TANF back in "06 for about 2 months and then got off it. In November 2009 I called her case worker and was told that I did not owe anything else and there was no continued order for me to keep paying. She was clearly lying because in the end of December I received that letter I just talked about. The grandmother does not agree with it at all and was very upset because any money her daughter is getting should be going to her. I have no problem paying child support but I do not want the money going to the ex so she can use it on drugs. I'm currently behind and owe $4,400 to my ex when she isn't title to any money at all. They took $659 from my taxes and gave it to her. She said she was going to end the case and waive the fees but she has not done that. I am under the process of getting my daughter back but I am waiting for a court date to terminate guardianship in Mass. I am very stressed out because my beautiful daughter means so much to me and for my ex to use that money on herself is ridiculous. She has no job and is receiving disability and hardly sees my daughter. What can I do to end this case and waive the fees and possibly get a reimbursement of my money since I have a copy of a court order in Mass. saying the grandmother has permanent guardianship, so that is the proof I have. Is there anything I can do to get her in trouble for this. I've talked to her case worker about this but she is not willing to cooperate with me at all, I told her I had no job and they are taking way too much. I don't have any money to pay for an attorney and any help will be much appreciated. The child support order is in NH.
