My question involves insurance law for the state of: Massachusetts
Situation: Late one night, I attempted to go onto a main roadway turning right onto the main road just after stopping at the stop sign. A tow-truck was passing me and I waited till the tow-truck and its long flat-bed went bye. What I could not see was the black vehicle he was towing behind the flat bed because there were no Drag-lights. I hit the black vehicle being towed.
The insurance company stated it was my fault because I should have proceeded with caution. I claim I did proceed with caution but that the tow-truck was not following Massachusetts rules--- that the black vehicle had no required "drag lights". I cannot find the regulation to support my case. Can anyone find where it is and cite the place etc and send it to me?
What are my chances of winning this case---that the tow-truck operator is at fault for the accident? Thank you for your help----its appreciated.
