I broke this out of the initial thread dealing with my ticket, which is here:

Ok - so I received the discovery materials today. The materials are dated June 9th (my hearing date is June 14th). The materials sent to me include:

- NOI signed by the citing officer (filed 2 days after issue)
- A case report signed by the citing officer
- The pilot case report (with stopwatch numbers and mile marker info)
- The stopwatch certification report
- The ATSM mark certification
- The flight sheet from the aircraft (19 stops from 4:30 - 7:00pm!)
- A WA state DOT letter regarding the ASTM certification (performed 9/5/06)

It would be a lot to scan all of these, but they seem pretty thorough - if there's something in particular worthy of uploading, let me know - I'm not sure what my best option is here - I was thinking possibly requesting suppression of the citing officer's sworn statement, since I recieved the discovery less than 7 days from my hearing date. However, IRL 3.1b states (in part) "...If the prosecuting authority provides the citing officer's sworn statemnet less than 7 days before the hearing but not later than one day before the hearing, the statement shall be suppressed only upon a showing of prejudice in the presentation of the defendant's case".

Another larger issue I have is that any contest by e-mail or written statement is supposed to have been received by the court no later than 7 days before the hearing date (doesn't make much sense to me, since I wouldn't have received the discovery materials then). This was an obvious oversight on my part, as I thought I just had to postmark it by the hearing date (I was waiting for my discovery materials to arrive before I put together my written statement).

Any thoughts and /or advice are very appreciated. Thanks!
