My question involves criminal law for the state of: GA
I keep reliving a situation that occurred back in December 2009 with my husband (now ex). I want to know from a legal standpoint, if anyone doesn't mind answering, was his behavior on this night against the law? I don't intend to file a retroactive report, I am just curious. This is what happened:
My husband, had been violent toward me in the past. I talked with him in November 2009, told him if "it" happened again I would leave. In December, we were having a verbal disagreement about our son's child care. I could see him getting really mad, and it is at the point where I would expect him to throw something, but this night he seemed to be working to keep it in control. We were sitting at the breakfast table. He got up and walked to the kitchen. He opened a drawer, pulled out a knife and came walking back and sat down in front of me. He looked at me, then the knife, then pulled up his sleeve and massaged his vein in his wrist, then holds the knife to it saying "kill me, use it, you are going to take my family, you are leaving, you are taking my kids, kill me, just do it.”
I point out I am not talking about divorce, we are talking about child care, and plead with him to put the knife down. He does not, instead he puts the blade against his neck. I am hysterical asking him to put the knife down. I am wondering if he is going to slit his own throat or reach across the table and stab me. He finally throws the knife down in front of me on the table and leaves the room. The next morning, he tells me he will "beat the S*** out of me if I show him that attitude again." I said nothing but of course what I was thinking was - you were the one holding the knife.
Just a few extra facts - I did call the police on an occasion that occurred later in 2010. I have a TPO and am in the process of divorce. I am in counseling, but I am curious about the legal side of that night.
