    Default Undercover LP Conduct

    My question is if an undercover LP comes after the accused shoplifter without identifying who he his and the accused shoplifter leaves thinking they are someone trying to jump them is this considered illegal? I thought the undercover LP would have to say"Hello I'm so and so with XXX LP can you please come with me to discuss the incident that occurred".

    Would it also be illegal for this undercover LP to push the person down and handcuff the person without even identifying who the LP is. Then when the accused person is taken to the room and says they have circulation problems to please take off the handcuffs and they have no weapons and they need to use the restroom or have water and are held for 45 minutes is this considered False Imprisonment. Since in some forums I read that LP should provide the person with water or let them use the restroom.

    When the person tried to get up from the chair because the handcuffs were too tight and they have a circulation problem and they are cooperating and are remorseful is this illegal and improper use of handcuffs?

    This is for US states.

    None of that sounds "illegal". It doesn't sound like he followed traditional LP policy/procedure but everything sounds standard. Especially if you were "resisting". Good luck in court.

    I did not shoplfit I was asking this as I heard some incidents where the undercover LP
    was not following protocol. Usually when you are stopping someone you need to identify yourself. So you won't see me in court(:

    Ok. To clarify, the alleged shoplifter can not be excused on a missed technicality on something that isn't legally binding. Different stores have different policies and it doesn't necessarily affect the outcome of the situation.

    The problem with the LP not identifying himself is that the attacked suspected shoplifter would be justified in defending himself, which could result in serious injuries which would really be the fault of the LP.

    That would help his case yes. It would remove assault from the alleged shoplifter but it would not lower the penalty for shoplifting.
