My question involves criminal law for the state of: Missouri
Hello all, I'm a Newbee so sorry for too much info,
I got caught shoplifting about a month ago and the store LP told me if I sign this paper saying that I took the item($9.99 pair of sunglasses) that evereything would be fine and all I would have to do is pay the civil demand notice of $150.00 and be banned from the store, so I did and right after that the police came and arrested me and went to jail($500.00 bond). So I'm assuming with me signing the paper I admitted guilt and kinda screwed myself, I did not get a copy of the paper so I have no idea what it all said. Not that it matters but I just came from the doctor and found out I need a hip replacement so needless to say I was in a great deal of pain at the time and needed to get a RX filled so while I was waiting for that I decided to grocery shop and in the process picked up the glasses and put them on my head tags and all, not wanting to break them in my cart, purchased about $60.00 worth of food and then picked up my $30.00 worth of RX and started to leave the store totally forgetting about the glasses and was stopped by LP. I understand by the law I did take something that was not mine but it was an honest mistake, well at any rate that is why I signed the paper thinking it was the right thing to do and I just wanted to get out of there cause my hip was killing me and was not in my normal frame of mind. I paid the Civil Demand right away and then talked to a lawyer, she said if I took a court approved shoplifting class($100.00) that this would really help so I did and now she tells me that the best she can do is get me a SIS with probation for 2 years. I have not been in any trouble since the mid 80's and have no record or pending offenses and now this. Is this the best I can expect, It seems to me I should be able to do better, is my lawyer doing me right or just doing the quick and easy. Any help or advice would be great. I just don't want to get screwed if possible.
