    Default Illegal Apartment

    My question involves landlord-tenant law in the State of: Maryland

    I ended the lease and moved out on Monday. The lease was wirtten on a District of Columbia lease agreement with DC law information, but the apartment was in Maryland. Does that void the lease and could I get a refund for any portion of the rent and utilities I paid for a voided lease?

    Also, I think the apartment is illegal because there is only one entrance/exit which is a safety hazzard. I beleive the landlord would need a permit to rent and that would not have passed safety code? Since that would make the apartment illegal, would I be able to get a refund for any rent and utilities I already paid?

    Mistakenly using a lease from the wrong jurisdiction doesn't mean that there was no rental agreement or landlord-tenant relationship. At most it would result in some of the lease being invalid, or in a month-to-month tenancy.

    Your belief that the apartment was unsafe means nothing. It was either inspected and approved as rental housing by the local unit of government responsible for overseeing rental housing, or it was not. Find out, and let us know if it was not.
