My question involves unemployment benefits for the state of: New York
Hi LSA:
I need your advice in in NY and was let go about a month ago. Here are the facts

- Employed 7 months
- In 3 months there was a change in leadership, the Director I was under was great the promoted one was not
-In January to May I received about 7 "write ups" which I did not sign due to them being frivilous in nature.

- I was an event coordinator/office manager and managed all the emaills/phones/office alone. I handled about 100-150 orders/events a week maybe one -two mistakes a week.

- Write ups were simple things such as clients not approving orders and changing times and receiving catering at different times even though they never disputed the confirmation sent.

- I spoke to the GM on multiple occassions about the gross abuse of the write up system and other issues to no avial, but he aasured me these were just documents and my job was not in jeopardy. I was never offered a platform to rebuttle or anything . One manager commented twice he was looking to write me up for anything to be his scapegoat so to speak.

- There are plenty of positive emails, unfort I did not have time to get them as I worked up to 3 hours before termination.

- Termination states : I sent an order to an improper floor and the client never received their order ( thoughthey did) and required a credit back.

- I workd on many occassion 40-45 hours per week though I was required 37.5.
- I received about 3 weeks of UI and then bc I wasnt laid off I had to fill out the questionaire. I think they are trying to fight it, my only worry is that guy wriote me up for any and everything, though I never signed anything and I think they will try to use that as grounds of misconduct though I made it clear to UI I was doing my job to the best of my ability. I am worried about having to appeal bc I havent worked in a month and have no real income (bills etc). Any oen go through anything similar.

Luckily I have 2 employees I can use a witnesses one quit due to the dept being a hot mess and and basically complaining and no one addreessing concerns.

What advice do you all have???

- Date of termination he rushed in and just read the termination , forced me to sign it and whisked me away, no real meeting at all.

Currently I have a week to wait for the final decision, they say about 3 weeks to get a response. I sent in the questionaire the day I received it via fax.

Anyone have any experience in these kinds of matters?
