In 1971 no one cared about taxes or lawsuits on our easement granted on our property to 3 properties across the street. After being sued for a slip and fall on another property we own, we are worried about a potential suit from this easement.
Further, one of the 3 properties with rights was subdivided about 10 years ago and and another house built on it. Now the additional house thinks they have rights. Am I obligated to maintain, insure, pay taxes on a right of way for all these extra people, their friends, family, relatives? I fenced off my side and have barely used it since the ROW was granted.
Do I have options? I don't want to be nasty, but it seems like I am taking on extra liability and taxes for someone else's enjoyment.
