My question involves paternity law for the State of: Michigan
I will try to make this as short but descriptive as possible..
During the process of going through a divorce, my son was born in 07/1993 but the divorce wasn't finalized until 12/1993. Initially the hospital didn't put a father down on the birth certificate. I just recently obtained a copy of his birth certificate from the State of Michigan and it shows my ex-husband as the father.
Now, I did move to Oregon in 1994, where I went through the process of getting a child support order on the biological father. During that process a paternity test was conducted by the State of Oregon, which concluded that the biological father was the father of our son.
I have contacted the State of Michigan vital records asking for them to change the father's name, but they are saying that they need a court order stating that my ex-husband is not the father. They advised me to go down to my local county courthouse (we now live in Indiana) to ask for the court order to be drawn up. So, went down to the courthouse and basically was told that they don't have jurisdiction in the case.
So, is there any chance of getting his birth certificate amended to state the correct father's name?
(Sidenote: Neither my ex-husband or biological father will do anything to assist in resolving this issue).
