    Default Working in H1-B

    Hi,

    My Name is Jaison Jacob. I came here in H1-B Visa and I worked for 2 companies (1 fulltime and 2nd parttime). Second employer give me cash all the time and I submitted that amount in bank. Right now I am in Greencard. My brother also worked for him the same way when he laid off from the first job. His greencard is not yet done and is still in process. We both worked for this guy back in 2003-04 mid.

    I would like to know is there any problem if the employer (second) informed INS about this. What should be the panishments for this.

    Do you have any reason to believe that the second employee would call up the USCIS and inform them (a) that then intentionally violated U.S. immigration law, and (b) that they also intentionall violated state and federal tax laws? It doesn't seem likely.

    But if you were caught, you might have to answer for your violation of your visas, and may end up owing taxes if you did not report your earnings.

    For some reason the second employer doesn't like me. Right now, one of his client given an offer directly (I have worked for this client through the second employer after I got the greencard for 6 months) . Now he started threatening me from taking this job by saying the previous work.

    Also I would like to know how it will affect my brother.
