    Default Establishing Grounds for Adultery

    Posting this for a friend of mine.

    My wife started withholding affection acting weird in feb of 2009 had people witness her on phone at different times when she said she was going to be going to work she was a block from home on cell. she left on march 20 2009 saying i beat her and had cops here wouldnt press them to take me to jail. few months she lived with her mother then i had good family friends say she was living with a man. had a boyfriend. the dates were told to me as to when they went on trips. i looked on her facebook and followed some breadcrumbs to pictures of her and the man together. the date go back to september of 2009 as far as i can see. I have 30+ pics as well as timestamps. we are still married and no separation was ever filed.

    do i have a leg to stand on for adultery in south carolina

    Tell your friend to simply file for divorce.

    He mentioned South Carolina, so it would appear he wants to know if his friend has sufficient evidence to establish adultery so as to pursue a fault-based divorce under that state's laws.

    Apparently the evidence is that after the friend allegedly beat his wife, causing her to file a police report and move out, she has moved in with a friend who is male and has gone on trips with him. It's not outside the realm of possibility that the living arrangements and photographs would be sufficient to establish adultery, as in South Carolina you don't have to establish any actual sex acts to establish adultery, but it's something he needs to discuss with his lawyer.

    If a divorce has been filed by the wife, I would assume she's alleging physical cruelty.
