    Default Caught with Escort by Security Guard

    My question involves criminal law for the state of: CA

    So in one of my moments of poor judgment, I "parked" with the women in a parking structure that requires automated tickets to enter and exit. During this time, a security guard walked past. We wasted no time leaving the facility once discovered, but it might be possible that the guard caught my license plate, as well as my car, and possibly my description (he and a co-worker saw us exiting as well).

    Between the guards and the possible security in the structure, how likely is it that I will be contacted by the police and charged with a crime?

    Also, what are the possible charges I might face?

    The guards likely did not get a good look at the women, so can it be tied back that she might be a working girl (though it was near a fairly high traffic area)?

    I am freaking out quite a lot right now, so any knowledge, advice, etc is greatly appreciated.

    If you get so freaked out about getting caught, I wonder how freaked you get thinking about how common STD's are among sex workers.


    several things would have had to happen for you to be charged:

    somebody would have to have seen a crime. If the guard saw something or a camera recorded something would be enough.

    then, the crime would have to be reported

    then, you would have to be able to be identified.

    so, given the level of security in todays society, I would expect the police to be surrounding your residence as you read this.

    Was that somebody knocking on the door just now?

    and you are commenting on my comment about the prevalence of STD's? My statement is based in fact. Yours is apparently based on some loathing for politicians. While there may be some politicians that would be affected, making such a blanket statement about all politicians is nothing short or libelous.

    I see the humor just too concerned, paranoid, or "freaked out" (sound too much like stoner lingo?) about the possibility of being arrested and charged with this to appreciate it at the moment. Bad move gone much worse I guess. Anyway, any and all info is helpful so thank you and continue having fun.

    As we don't have a crystal ball, we can't tell you what the security guard saw, whether he obtained your license plate, whether he could identify you or the woman, whether he notified the police, or whether the police would find that there was sufficient evidence to justify investigation or a prosecutor would authorize charges.

    You're going to have to wait and see what happens.

    From what you have said, I seriously doubt you have anything to worry about. About the only chance of any charges, from what you describe, would be due to a camera. Unless you were parked where a camera got a good view of what was happening, I doubt you will hear another word about this.

    Even if there was a camera, somebody would have to report it to the police and all they would have is some sort of lewd act. Proving the prostitution part takes more than just seeing you in the act. There has to be proof there was money involved.


    If the guard didn't say anything when he had the opportunity, I doubt he will make a big deal about this.

    Honestly, if it were caught on camera, I would bet there is a better chance of it ending up on YouTube than at the police office.

    Obviously you need to stop meeting escorts in parking garages where you are known.

    Seriously, no security guard has police powers. A police officer would have to witness illegal conduct to make a misdemeanor arrest. The only way any other witness could do anything is by going to the state attorney/da and making a complaint under oath. No security guard or other third party is going to do that. I am sure nobody actually say anything that was illegal anyway.

    Unless there was a camera looking right down into your car, you don't have to worry about video.

    With your level of paranoia, you should stop doing such things and follow a more traditional route. Or at least know the law and be more clever about the way you do things.
