    Default Civil Case Over Old Debt

    I found out today I am being taken to civil court in Pennsylvania for an old CC debt from 2003. My family received a certified letter in the mail from the district justice, the plantiff is the bank that holds the debt. I had never been served or heard of any civil case pending. This case was filed back on 11/01/2007. It is well past the SOL in PA, can I call the district justice and tell them it is past the SOL and to dismiss? Does the SOL apply to civil action as well as filing dates? This debt is nearly 8 years old.

    If a case was filed in 2007 and you defaulted, you're now dealing with a judgment debt and not the original credit card debt. I suggest researching the file from the 2007 lawsuit to find out where and how they claim to have served you, and why you were not actually served.

    I checked my credit and there is no judgement on it from this.
