    Default Parents' Agreement to Pay Their Child's Restitution

    i am in a similar situation exept we are not related. Some kid stole a car from us, caused 500 dollars in damages in 2006 and since probation officers, collections couldnt do anything about him not pay. Finally i was in need of my money 4/3/2010 I found out where the kid lived talked to the mother we came to a agreement where they would pay me the 500 and at the end I would call collections and let them know he paid.

    Probation then contacted me after collecting half that I wasnt able to do that because that would be violation of his probation not paying collections. So I since stopped and its been a month and I called collection and now he hasnt paid anything and is in juvenile hall again for violations.

    Should I just take the mother to court for the remainder since he was 16 when he commited the crime she should be responsible right?, and be ordered to pay?

    any suggestion I want to get this money collected and put it behind

    who ordered her to pay? If the court ordered only your sister pay as restitution, then that is who owes you. Per Mr. K's cite it would appear that the court would include the parents if they deemed them to have liability.

    and there is this as well:

    (5) The court may retain jurisdiction over a child and the child's parent or legal guardian whom the court has ordered to pay restitution until the restitution order is satisfied or until the court orders otherwise, as provided in s. 985.0301.
