    Default Fifteen and Needing Emancipation

    My question involves emancipation laws for the State of: Florida

    Hi I’m a 15 year old sophomore in Florida. My grades are excellent (straight A’s). Pretty soon I'll have enough credits to graduate early. Well I have a very big dilemma. My guardian WANTS me out of the house. She plans on sending me to Michigan, where the economy is bad and I have more than an 85% chance of getting raped or killed. I have no problem with leaving because I have been physically and mentally abused for years and I can't take it anymore. If I became emancipated I would already have a family that is willing to take me in. I have known them for more than 5 years. I have even lived with them temporarily with the consent of my guardian. My having no job wouldn't be a problem because I get a check every month since I'm adopted. (It’s over 500$ a month) Could they make the exception then?

    If you are being abused call CPS and/or 911 immediately.

    Emancipation does not mean you go to live with another family.

    What you may want to do is advise the family to apply for emergency guardianship of you.

    For what it's worth, $500/month won't even come close to providing everything you would need to prove to a court you are self-supporting.

    Where are you getting the 85% figures from?

    That's completely bogus.

    And...are you being sent to live with another parent? Other legal guardian? Who/what is in Michigan?

    Emancipation is NOT going to happen. (And BTW, I live im MI, have raised/raising 10 children here, and there is NOT an 85% chance of you being raped or killed.) Further, $500 a month doesn't go far, in Mi or elsewhere. If you have a guardian, they should be overseen by a court officer. They will probably ask you WHY the appointed guardian wants you gone. If you are being abused, talk to a school counselor/teacher and have it reported.

    In Florida, your parent or guardian would have to initiate the emancipation proceedings, and you would have to be at least sixteen.

    Those threads sticked at the top of the forum that you're instructed to read before posting a new question? There's a reason they're there.

    I'm interested in a citation for this "85% chance of getting raped or killed" nonsense.

    Honestly, do you think that just pulling made up statistics out of your hindquarters is going to suddenly create an exception in the law for you? THAT, my dear, is called "magical thinking", and would ensure, even if you did have the means to support yourself (which you don't) that a judge would laugh you out of the courtroom.

    by being emancipated couldn't i decide where i want to live

    well in the part of michigan where im going to be sent there is a very high chance that i could be raped or killed. trust me i know.

    You're 15 and live in Florida. You "know"? You know nothing.

    You don't even have an 85% chance of getting killed in DETROIT, and the Motor City has some pretty scary crime statistics. Making things up will not get you what you want.

    You're not only incapable of supporting yourself, you're incapable of using logic. Emancipation is not even remotely a possibility for you.

    Well I would like to have you know researchermissy that I did'nt pull those statistics out of my "hindquarters". The area where i would be sent is swarming with perverts, killers, molesters, and rapists. It may not be an 85% chance in the area u live in but in the area that I am being sent to those are the statistics. So go there nd see for yourself!!!!

    Cite it, little girl. Show me a government source for your nonsense. Again, you're making it up.

    And you're not listening. Emancipation is not an option for you. If you're incapable of supporting yourself 100%, your petition will not even be heard, even if your guardian were to initiate it.
