    Default Final Paycheck Issue

    I have been working for a Tim Horton's Franchise since October of 2005, I was hired in as a Supervisor at $8.75 per hour. Since January 2006, I was told I was next up for General Manager and my job performance was outstanding.
    I had just gotten married in November of 2005, and I have 2 teenage daughters that are employeed as well, neither of them have thier own vehicle, so I have to transport back and forth daily. On two occassions, I was to open at Tim Hortons, (when I say open that means I am to be there at 5:15am, but doors open at 6:00am) I was running late, approx. 5 min. My boss came to me and said that he had to desipline me for my behavior and told me he was taking my promotion away from me for 1 month, (which would have been until May 12, 2006) I was extremely upset due to the fact that I am not currently the General Manager of this store and yet, all the help call me in the middle of the night to come bring them change, or the baker called off, they need me to come in, this goes on at least 2-3 times a week. There are days when I don't sleep for 24-48 hours at a time. Well, on May 10, 2006, they pulled there last straw, I had closed this night, and we had had a delivery that night, I had put all the frozen and refrigerated stuff away, but left the dry goods until morning, knowing I had to open. (it was 12:00am when I left there.) Around 1:00am the General Manager of the store came in and left a really nasty note for me on the computer screen regarding the dry goods that weren't put away. The night girl called me to let me know he had done this and at the same time told me that our baker that was scheduled to be there at 2:00am was not coming in. I told her to call the General Manager, she said that when he left the store, he told her not to call him for anything, he was going out with his friends and that she was to call me. I was really upset, I had not been to bed yet, and I would have had to go in, in less than 30 min. and work all night and all day. I told her I was gonna call him myself, she said he told her he was not gonna answer the phone. But I told her I would call anyway, I blocked my phone number and called him, and he answered the phone, and I started talking with him, he started to yell at me, and told me how it was my job, I told him that I was not going in and he needed to do HIS job. He told me that I didn't know what I was saying and to be at work in the morning to open, he would find someone to come in and bake, and for me to remember I was still on punishment.
    Well needless to say, my husband told me he did not want me going in there anymore, they can find someone else to take advantage of.
    Well, Friday the 12th of May came and obviously i had quite, and I went to pick up my paycheck, My boss had dropped my rate of pay to $5.15 per hour, which is less than what our regular crew members start out at, He kept $400.00 of my money, and said he had the right to do that because I did not give a 2 week notice. Is this right? I was under the understanding that at will employment meant you could leave when ever you chose too and vice versa. Is there anything I can do about this??

    No, your employer cannot unilaterally or retroactively reduce your wage. Your exact rights and remedies depend upon where this occurred.
