    Default MIP in Michigan, 17 Years Old

    My question involves criminal law for the state of: Michigan.
    17 years old.
    Hello, This past weekend I was cited a ticket for a MIP (minor in posession) and here is my story.
    I was at a very small party at the beginning of the night. People were drinking and what not. A few friends and I stepped out back, soon after we heard that the cops were out front. We walked down about 5-6 houses and peaked out at the street to see if any cops were there. To our surprise there were 2-3 cop cars sitting right in front of the house we came from. We then saw flashlights/police dogs chasing people through the backyards/open field tat the house was off of. We proceeded into the front yards of the houses and were planning on just walking away from the property. Two cops jumped out of bushes and said "Move and you get tazed." So we did not move. The cops took our information and asked if we had been drinking. We said no. Then he took us back to the party and eventually made us breathalyze. I blew a .05. I was wondering since he did not find us on the actual property where the alcohol was found that he still had the right to breathalyze me. He did not give me an option on whether I could deny the test or not or if there is anything I can do in this situation to get out of the possible problems I may face.

    I would have to assume that the officer would testify that you smelled of alcohol and showed signs of intoxication. But as you have shared no facts to help us understand why the officer focused on you, we can only guess.
