    Default Left Husband Before an Initial Interview

    Hello,
    I’m a citizen of Russian Federation. I’m in the United States since August the 1st 2009. I came to the US like a temporary visitor (B2 visa). My visa expires in March 2011. The date when I have to leave on my Arrival-Departure form (Form I-94) is January the 30th 2010. But on December the 10th 2009 I got married to an American citizen and then I applied for a permanent residence. We were together for almoust 3 years. Last time I has come in the US because we made a decision to live together here which was a big sacrifice for me.
    We had our initial interview scheduled on April 15th 2010. Last 4 months we’ve been living separated. I left him because of constant verbal abuse (my husband has a bipolar disorder and he didn’t think that he needs any other help exept his medicine). So we missed our interview date.
    Right now we are in process of getting divorced. We made this decision together and on the good terms.
    I would like to get a temporary visitor status back. It’s my third time in the United States. I don’t have any criminal record. I was hoping that after the one wrong decision I made I still will be able to come here and see my friends. But how I understand after talking to a few immigratin attorneys its impossible without leaving the country.
    My husband told me that he didn’t get any other information from Homeland Security department since I left.
    I would like to know what’s the best next step for me in this situation? I’m looking forward to your help.

    Well, I suppose you could marry a different U.S. citizen and try to immigrate through your new spouse... although I expect that the USCIS would be highly suspicious of the marriage. Realistically speaking, your lawyers have been advising you that you'll have to leave the U.S. because that's what you'll have to do.
