My question involves criminal law for the state of: CT /NH
My friend is on probation in NH from CT for a non-drug related offense. Even though he has no history of drug use, he does have an extensive record. His PO has drug tested him recently, and once he tested positive for marijuana, and then some time later (this week), he tested positive for marijuana and cocaine. The PO did not arrest him on the spot but said he is sending the report back to CT. He is also insisting that my friend transfer back to CT because his PO said he no longer wants to deal with him and if he stays, he will see to it he is arrested. We are unclear what this means. Does it mean that he has a greater chance of beating the dirty urine if he voluntarily goes back to CT, or is the PO threatening that he will "put the screws" to him on future offenses if he stays. This PO has been known to threaten my friend, and others I have known, with actions he did not end up taking. Can my friend be forced to return to CT? What does this mean? What should he do next?
