    Default Step Parent Adoption, No Paternity Established

    My question involves adoption law for the State of: KY

    I have a five year old son, his biological father has not been invovled in any aspect of his life (the father's choosing not mine.) He did not sign the birth certificate and paternity was never established. I have since married, my husband has supported my son for the last four years. He would very much like to adopt our son. The biologically father was an internation student from Kenya when we met. We have tried several times to find him to obtain his consent to adopt to no evail. We're not even sure he's still in the country. Is there anyway an adoption could possible go through without his consent?

    You may be able to have biodad's parental rights terminated on the grounds of abandonment. Typically, if there is absolutely no contact for a specified period and the parent is untraceable, it's a pretty straightforward procedure.

    It's in your best interests to consult with an attorney in your area that specializes in family law.

    I am in a similar situation, my daughter is 11 years old and my husband has been her dad for 7 years now. My daughter's biological father's name is not on the birth certificate and he has never established paternity. I have spoken to a lawyer and he said we would have to start with them trying to find him and his whereabouts. If and when they find him he will be served papers to sign. He has 30 days to consent. If they cannot find him in the 30 days they will proceed with the adoption. It's just a longer process than if would have to be if they consent to it.
