Hello World,

I came to the US many years ago and started a small consulting business. For that I obtained an E2 (at considerable cost to myself).
Now the US economy forced me to seek employment overseas and I went to work on a project in Europe.
Problem is my current E2 is due to expire by the end of this year, but my passport already expired a month ago.
So I had to apply for a new passport and my E2 visa is now still glued into my old one (with my old passport's number on it).

I now I could go to the nearest US embassy to have it transferred, but because of the difficult logistics in this backwater place, I had fallen behind with me paperwork back home in the US.

And thus I failed to send in the bi-annual filing required to keep my business registration in good standing.
I checked that I could still file for that now, but now I have to pay fines & tax penalties totaling over $1000.-

Normally that wouldn't be to much of an issue for me, but pay on this gig was abysmal at best and I'm really, truly teetering on the margins here.

I have a project upcoming in the US that would get me enough money to get it all worked out, but they don't offer any advance pay and now I'm worried:

If I go to the US embassy to have my visa transferred to my new passport, will they check if the registration for my small business in my home state is in order?
And what if they find I didn't send in my bi-annual filing on time?

Can I just take my old passport with me to the ICE Officer at the entry port - and would they still let me in if I'd show them a valid E2 visa stamped into an invalid old passport?
