Our landlord bought a forclosed house, with express purpose of selling it to a couple. They signed a purchase agreement, the owner allowed them to move into the property, and a closing date was set for 3/1/06. I should also add that this was to be an owner carry. The people showed up at the title company, and everything was fine until the contract was explained to them, as it had a balloon payment at 5 years clause. That upset them. Then when they were told they had to reimburse the property taxes that had been paid ahead, they went totally balistic. They walked out of the title company, and there was no word from them for over 2 weeks. The owners attorney sent the "buyers" a 30 day notice to vacate the house. The owner doesn't want to sell to these people anymore, she wants us to buy. The people won't vacate the house so we can look at it, and they are now suing her for a lot of money because they say that since there is only a stone foundation they won't be able to get it financed in 5 years, and that she knew that when the contract was drawn up. What recourse does she have to get these people out of her house, so she can sell it to someone else?
