My question involves collection proceedings in the State of: VIrginia
Hello. My husband is in a unique situation. Back in 2007 he had a traumatic accident and tried to work after but the mental aspect got the best of him. He has about 50 grand in CC debt but with different CC companies. One of them, issued by Bank of America, he owes 26 grand. Keep in mind he did not run up all this debt illegaly. "A atty" sent him court papers in civil court, asking the judge to grant a judgement. My husband has a house in SC and 33 grand is owed on it and no other assets. Since the accident he has lost everything to hs name. We do however live in VA in my house which is valued at only 9 grand with 5 left to pay. He is now a VA legal resident. My question is, can he go to jail for owing that much on a CC? Also, what can the "atty" do about is house, can they take it or put a lien against it? In the court papers it says nothing about the debt being from Bank of America, only FIA card svcs. Techincaly he did not payments to FIA card servies, only to Bank of America. However this is a bill from Bank of America attached to the back of it. The Bank of America CC is unsecure, like all of his debt. He has kept his house payments on time due to renting it out. He also is now on Disability because of the trauma from the accident. He has papers to be in court on June 11,2010. Is there anyway he can postpone this court date to a later one? Can someone help? We are nervous about this but there is no way we can pay that debt and have very little money to hire a bankruptcy lawyer yet. We both will be filing for chapter 7 when we can save to hiree a atty.
Also, does anyone have the link for bankruptcy law in VA? Does anyone has a link to the State Bankruptcy process in VA? I found it once before on the net but can't find it now.
