    Default British Girlfriend with 10 Year Green Card Expecting Our Baby

    My partner and I just found out we are 2 months into a pregnancy. I am British and live in UK and she is British with a recent 10 yr green card. She was intending to return to UK for up to a year to be with me, study and look after her grandparents before applying for her full US citizenship and going back to US. The child is a bit of a surprise and so we have some important questions.

    - If the child is born in the US, we hear it will be granted Dual Citizenship. Is this true. And is that only until the child is 18 yrs old?

    - If the above is applicable, and my girlfriend succeeds with her citizenship application, what options do I have as the father and partner of the mother? We do intend on marrying in the future, however finances will be concentrated on the child for the time being.

    The ideal outcome would be for us all to be together, naturally, in the US. If there are any problems presented we will simply remain in the UK.

    You refer to "recent" green card. When was it obtained? And upon what basis?

    If the child is born in the U.S., the child will gain U.S. citizenship. I would expect that the child would also be eligible for U.K. citizenship, assuming you file the necessary paperwork with your government.

    If your girlfriend becomes a U.S. citizen then as a citizen she will be able to petition for you to come into the U.S. on a fiance or, if you marry, spouse visa.

    Thanks again.

    Just another possible situation, if she was to come home here to have the child and then she was successful in getting her citizenship next year, and we were set to go back to the states when the child was a few months old, what would the situation be then?

    Her green card has been in application since her divorce. She got it 5 weeks ago.

    Wait - if she only got her green card 5 weeks ago, on what basis will she qualify in obtaining citizenship next year?

    When was her divorce (presumably from a US citizen?) finalized?

    This could impact things a bit...

    Well, we have decided to have the baby in Florida. and come back here to the UK for the spring / summer next year where we have a home and many friends and family around us.
    What we need to know now is whether the child can petition my green card before my partner get her citizenship. We will apply for the baby to have dual nationality of course. Going forward we may have to file I-131's to preserve naturalization whilst we save enough money in UK to buy a place. There are so many thing s to achieve - credit history gets reset when we move to USA!! Since i work in Oil n Gas and can earn substantially in UK or Offshore for a while before going back to settle in Florida. I will need to spend a lot on money on courses for my work qualifications to the USA equivalent... (lunacy this is, the British and European standards and specifications are twice as strict as the US!!!!)
    Her divorce was finalized a year ago, 1 year after the marriage breakdown. And since then her 10 yr green card was issued. We intend to marry without a doubt. all info appreciated guys.

    A US citizen child can only petition for a parent beginning at age 21. There is no way an infant is of any benefit to you for US immigration. Please see the USCIS.gov section on family based immigration to review your options.

    Nope. As T said, not until the child turns 21 can s/he confer any immigration benefits to you.

    You need to think of another plan, unless you get married sooner rather than later.
