    Post Vehicular Manslaughter

    My question involves criminal law for the state of: California.

    My fiance is in jail for vehicular manslaughter; he still hasn't officially been charged. His trial is on Tuesday. What I want to know is what to expect, in regards, to sentencing?

    -I don't know any exact details about the case.
    -He has no priors, is a college student, and overall he is a good guy.
    -He passed the physical sobriety test, but I don't know what his breath test was.
    -Terrible accident that resulted in the death of a 66yr old man.
    -My fiance is multiracial, but he will be seen as a black man in the courts, so I am scared "they" will try to convict him, just to get someone in jail.

    S0, what are the possible outcomes, in regards to sentencing time??
    What should I do to help his case?
    What should I not do?

    His trail can not possibly be Tuesday if he has not yet been charged with a crime. Does he have a lawyer of his own or has he requested a public defender??
    I'm going to ignore what you said about his race.

    His father told him not to talk to anyone at all, until he meets with his lawyer. His trial isn't on Tuesday, it's his arraignment (I didn't know what this was called). I am not sure if he actually asked for a lawyer already.

    What can you tell me about the sentencing outcomes?

    The arraignment is NOT a "trial." That will be a hearing where the charges will be read to him and he will be asked for a plea. If he has not yet engaged legal counsel, he will be asked if he needs appointed counsel to represent him.

    Sentencing is still a long way off. Even if he pleads guilty at the arraignment, sentencing is still some time away - maybe months.

    He really needs to speak with an attorney ASAP.

    when you say "they" do mean, like, "the man"?

    I suspect he will not get any special treatment regardless of being seen as a black man and will be treated just as poorly as the whites are treated.


    Most people convicted of crimes actually are guilty.

    The sentencing outcomes will depend not only on what evidence is on both sides of the trial, but also what he is EXACTLY charged with on Tuesday. Sounds like his dad knows the routine. Don't talk to anyone but the lawyer - you should follow dad's lead.
