    Default Threatened With a Statutory Rape Charge

    Some people I know are threatening to go to the police accusing me of having sex with a 15 year old girl. I am recently 19 years old, and am worried about having charges pressed against me. The father of the girl would be testifying on my side. Further, I am away at school and my parents live in a different state than her. Considering they have no evidence to back the accusation, what are my chances of getting convicted? I am in Florida

    we have no idea what evidence or testimony the police can gather for your prosecution. As such, there is no way to determine if you would be charged, let alone the chances of being convicted.

    there is no evidence that will support the claims, and I have many testimonies from friends and people close to the situation negating the claims

    I notice that you are avoiding the two big pieces that we need.

    One, did you have sex with a 15 year old girl?
    Two, in what state did this action happen? Did the girl cross state lines for the encounter?

    If the PD dosn't have any evidence or statements from any victims or witness then why are you worried?

    well, you and the girls are the only two that would have first hand knowledge. Your friends would be alibis. Since they are friends, their testimony would be suspect.

    so, why did you have sex with her?

    We don't actually need the answer to that first question, but if the answer is "yes" then it becomes obvious that the chances of prosecution, the chances that there's incriminating evidence, and the chances that the girl will end up testifying against you go way up.

    i did not have sex with her. as i said in the first post, we are in florida. she is my best friend and is going to defend me. i was just curious as to how much it would take for charges to be pressed and what would have to be found in an investigation

    For an investigation to occur, a report would have to be made to the police or a mandated reporter. For charges to be filed, there would have to be some form of evidence that the prosecutor believes justifies filing charges.
