If your ex- is willing, you can include language in your divorce judgment making clear that she has no claim against your newly purchased home. The immediate wrinkle is that your lender may require her to sign documents at your closing to waive any rights she has in the event of foreclosure. You may include in your judgment the requirement that she execute a deed, after the divorce is entered, relinquishing any claims. I suggest having a real estate lawyer prepare the deed, to make sure it's in proper form.
