My question involves divorce in the State of: MN
We are going through a divorce without attorney's and she filed all paperwork the beginning of April. I then got a letter the beginning of May that a judge was assigned and she just called today to check the status and was told that we were missing some paperwork. She is going to get it filled out tonight and drop it off tomorrow but was told that we probably cannot get a court date until July now.
My problem is that I was set to close on a house in June and if I do, I believe it would be considered marital property. I don't want to push the closing back because I would lose out on the tax credit. Is there any way around this? Since I have papers showing that the divorce has been filed, is there any way that the house could not be considered marital property? Not to mention that my earnest money check has been cashed.
The only other thing that I can think of is to go through with the closing and then do a quitclaim. I think she would do this willingly and no fight it.
