Default Is It Forgery to Send a Letter Using Government Letterhead

I was wondering if this will count as a forgery.

My neighbor (correctional officer) made a complaint against me (neighbor dispute) using a head letter from the department of Correction.

But, it is not a real head paper, my neighbor just wrote on top of his letter (in small letters) “State of California” (Top right of the paper) and below “Department of Correction and Rehabilitation” (no logo and small letters make me think that it’s not an official head letter). As a correctional officer he probably thought that his story will have more weight if he wrote that on his paper.

Will it be considered as forgery?

You also need to know that, this neighbor is making a false accusation using this paper. An hearing has been set where my eye witnesses are coming to prove the false accusations.

This guy also, wrote his complain as Officer XXXX while the dispute happened while he was at home and off duty (but he was still wearing his uniform since he just came back from work).

    So forgery or not?????

Unless you are a prisoner in a facility where this clown is a guard his position means nothing. Forgery no. Likely against policy, probably call his supervisor.
