    Default Who is Eligible for Deferred Findings

    I got a 12 over speeding ticket in Clark County, WA. I requested a contested hearing because the officer did not submit a full report right away. After he did, my lawyer refused my case. I already asked for an extension and waved my right to speedy hearing. I have two infractions on my record: 65 in a 60 and failure to signal. Am I no longer eligible for deferred findings? I've never deferred a moving violation before.

    According to the law (see RCW 46.63.070 (5)), the only two restrictions for a deferral are that you don't have a CDL and the you haven't received another deferral within the past seven years. But, deferrals are ultimately up to the judge.

    Thank you. Since I have no time to get a lawyer before my hearing, this is my only option left. I hope the judge has their coffee!
