    Default Bank Garnishment

    My question involves judgment recovery in the State of: Maryland

    I won my small claims case and filed a Bank Garnishment against the debtor. I sent bank garnishement certified return receipt requested to his bank, I received the signed return receipt back today from the bank. Can I call the debtors bank and ask if the debtor still has a bank account there or is this not legal for me to do?

    There's no law preventing you from calling the bank, but I am skeptical that they'll offer you useful information by phone.

    Really, you'll know in a few days whether there was an account, and how much money was in it (up to the amount of the judgment or order of garnishment) because the bank will relate that information to the court.

    You can call, but they won't even think of giving you any information whatsoever!!!

    Thank you Mr. Knowitall and Antigone, I took your advice and am just going to wait until I can find out from the Court. I do have another question though, do you know if the defendant's account would be completely frozen, provided he still has an account there or is just the amount of the garnishment (if that amount is in his account) frozen and what does the bank do with the money that they take from his account? Thank you for being so helpful.
