My question involves criminal law for the state of: Florida.
I was arrested on warrant and not given any information about the charge from anyone. a week later I hired an attorney because I have heard horror stories about public defenders. They filed discovery and we are awaiting the 15 day period. I search my name on google and the first response is my former employer who started a blog just about me and my arrest. Saying I stole and shipped something on his account. I did not steal anything I had received an item from him 5 months earlier and it was in my possession that whole time as restitution for working overtime at home and sold it on a classifieds site and asked him if I could use the account to ship the item to the purchaser (Using the account is common business practice) and was told "that will be fine". I kept him updated about the shipment verbally and told him to take the charges out of my paycheck "he said ok again". I then went on vacation and my wife convinced me to look for employment elsewhere so that I can go to school full time so when I came back I quit and 2 weeks later I am arrested for theft at my house in front of my wife. This employer made a blog about my arrest and all kinds of posts pretending to be one of my friends then listing out my so called crimes, complaining about my possible punishments that DA said I would have and warning any future employer because my record will be sealed. I didn't Steal anything everything was thru verbal contracts and I had the item in my possession for a long length of time. Why was it only reported after I quit? He stated he did not know it was stolen until the shipper damaged it in transit and it was returned to him since it was on his account. He also kept my last paycheck that would have covered any shipping charges. Sorry for the long post I just haven't seem able to talk to anyone about this yet as my lawyer still hasn't received discovery and the cops never came to talk to me. I am losing a lot of faith in our legal system.
This is my first charge and I have never been in any trouble before.
